The phenomenon of identity, first examined in the domain of social and political science, is now undergoing a significant change from the perspective of its legal interpretation. Understanding of constitutional identity can be achieved through analysis of two opposite vectors of transformation of modern law – i.e. the internationalization of constitutional law and the constitutionalization of international law. We discuss constitutional identity in the context of relationship between national and international law and analyze how constitutional identity reflects in the rulings and conclusions of the constitutional courts of a number of European states and Russia, as well as in European Union Law and practices of the European judicature.
